Well yes, of course it isn't.
Also worth noting that what the court is deciding here is whether the organisation known as "the chruch of atheism" specifically is a religion for legal purposes. They were not deciding whether the concept of atheism is a religion in actual fact. Nor would a court decision have any bearing whatsoever on that question, one way or the other.

I think if there was a larger movement, one that better organized to meet the requirements, such a group might get get that status. Reading this part at the end:
makes me think this wasn't that much of a "charitable" organization.

The 'Church's' efforts were a bit amateurish. But they may have revealed weaknesses in the exclusion of atheists from religious tax exemptions Church of Atheism loses it's Battle

Since Americans have the right practice their religions... and since "Atheism Is Not A Religion"... Then does that mean that Atheists don't have any rights to have "Freedom From Religion"? Does that mean that Athiests don't have the right to tell "Jehovah's Witnesses" to "Leave"? Personally, I'm not a religion person...But, I am also not 100% convinced that there is No GOD... As someone who is sitting in the middle of THAT fence (Ouch those posts are sharp. LOL!), I still firmly believe that, people should have the right to have "Freedom FROM Religion", if that is truly what they want... No one should having "Jehovah's Witnesses" getting in their faces, trying to convert them. While not a big surprise, this court decision is still disappointing. Well, nobody is marching atheists into church, synagogue, temple, or any other place of worship. to my knowledge.
