So Bucky and Steve claim that Bucky was brainwashed into killing Howard and Maria Stark. If true, then that would mean Bucky was just an assassin following someone else's orders. So if true, then whoever supposedly brainwashed and ordered Bucky to kill Howard and Maria Stark are also guilty of their murders. But police and law enforcement have no information about that because Bucky is the only 1 who knows who allegedly brainwashed him and ordered him to kill Howard and Maria Stark.
Now if Bucky and Steve would do the right thing and have Bucky surrender himself to the police for the killings, then Bucky could provide evidence against those who allegedly brainwashed him and ordered him to kill Howard and Maria Stark and then the police can use that information to go after those people. But Bucky and Steve refuse to have Bucky do the right thing and surrender himself to the police and provide evidence against those who allegedly brainwashed him. So thanks to Bucky and Steve, the killer(s) (Bucky and those who allegedly brainwashed and ordered Bucky to kill the Starks) of Howard and Maria Stark remain free and unpunished for the violent and brutal killings.
