Universal have distribution rights to any stand alone Hulk movie, they have no ownership of the character or associated characters, his is why Universal doesn't make their own Hulk film, they lost or sold them back to Marvel a while back but retained distributions rights, for how long though is unclear, could be time limit based of number of films based, one would allow Disney to just wait them out the other would require Disney deciding never to do a stand alone or coming to some agreement with Universal down the line.
Also pretty sure it's officially part of the MCU much of the film is referenced in Avengers such as time between Banner's episodes, Banner trying to kill himself though cant recall if this is in the film or a deleted scene, breaking Harlem and such, plus it's referenced in AOS and stuff also.
Banner shooting himself is a deleted scene from TIH, with the Cap in ice Easter egg as the ice underneath is breaking apart. That was a good reference, though. Although odd how they reference both endings in Avengers, the attempted suicide and Banner being able to hulk out at will, especially given both I think reveal Cap's shield in the ice, that's just contradictory right there that is.
