First of all he's not asking for advice from lawyers or police for people going after Brie, but people calling and texting him.
Edit his quote: “I’ve been texted and crank called kind of relentlessly over the past couple of days,” said Levi. “I tried to reason with these people, but now, I’d like to prosecute them to the fullest extent of the law.”
I didn't know the legalities of calling and texting someone constantly if you ask them to stop. Especially if no threats are expressed during the call.
I looked it up if Zachary lives in California it is illegal to constantly call or text someone without threats.
California Penal Code section 653(m)(b) makes it a misdemeanor to make annoying phone calls. The charge carries up to 6 months in the county jail. The elements of the crime are: 1) that you made repeated phone calls to the individual, 2) that you intended to annoy them at their residence, 3) conversation may or may not have ensued from the calls (in other words it doesn't mean that either party actually had to say anything), and 4) the phone call was not made in good faith.
Now is this the appropriate way to deal with this? I'd say not, but technically if they are calling and texting him without good faith of a conversation and constantly doing it they are breaking the law.
