Also depends on a IP holders intentions with the IP, if they have no plans to use Red Hood in a major way anytime soon DC are less likely to care, as all this will do is generate buzz and new content for the character which DC don't have to spend a penny on, if the makers make money off of it somehow DC can also demand their cut or if the product reflects badly on them in anyway they can demand it be taken down for that also.
Making a free Mario game for instance though can create competition, even if it's free, hell especially if it's free as the idea is well even if the free game is only half as good as the official game how many people will not buy the £40+ game and just enjoy the free game instead, also say if people were waiting years for a new game to come out the free game can hijack that anticipation so when the official game comes out the clamouring for a new games died down
