Let's be honest: It was Stark who killed him. Peter is the one who comes up with the plan, and he doesn’t seem to have any qualms about it. I’m pretty sure that would still qualify as murder if they were in a court of law. Or conspiracy to commit murder. But then again, Maw had abducted and was torturing Dr. Strange. He was killed in an attempt to rescue Strange. The courts would take that into consideration. So it might not even fall under the murder category.
