I'd have to question the empathy levels of anyone who decided to make out on top of Ground Zero two minutes after the towers fell. But while a lot of the damage was already done in MoS, BvS probably could have reversed it with a more traditional Superman and no one would be criticizing this image.

On that note, I do find it interesting how Snyder and his fanbase are using said image to prop up his Superman. They spend a lot of their time defending what you called "mopey" and "broody", always saying "We'll get that sunny Superman next time!". Yet here they are cumming over the exact opposite of that. I'd probably respect them more if they just came out and said they hate Superman, they hate what he stands for, they think he's a libtard pussy and they wished Superman were Charles Bronson with Krypton powers. No "this is just character development setting up that traditional Superman for later". No "Superman did X in this issue/episode/cut of a movie so it's fine for Snyder's to do it literally all of the time". Just brutal honesty akin to Frank Miller (Snyder's biggest inspiration after Ayn Rand).
