Apples and oranges -- not the same fruit or thing. The archaic rule for the first six Oscar ceremonies doubled up on film years (1927-28, 28-29, etc.) until finally straightened out in 1934. The GG ruling was put there to avoid the confusion of release date with Oscar ceremony -- a common misconception. But the Jannings and Gaynor nominations were not consecutive -- they were for the same ceremony (just like Holly Hunter in 1993 getting nominated for both PIANO and FIRM). Allowing what you are suggesting is to invite chaos! The advantage of being Quizmaster -- "That's my ruling" (to quote Judge Roy Bean).
