The only thing I can think of is tourist visa. But if so, she wouldn’t be allowed to work, so how could she be a paid member of the Avengers? Her pay obviously wasn’t official so she couldn’t have paid any taxes either.

All I know is they said it was Sokovia, they didn't mention any city name. Maybe Sokovia was like a single-city country like Singapore or Hong Kong. In any case, her home was destroyed by war and she was part of wartime experiments. Refugee status makes the most sense.

Captain America doesn't allow any Avengers to be put on trial because Cap believes that since the Avengers are more powerful than ordinary people, the Avengers should rule over ordinary people instead of being tried and judged by ordinary people.

He believes that Bucky was innocent due to mind-control. He also believes that Zemo should face justice for killing dignitaries in Brussels. Yet Wanda used mind control to lead Hulk to kill thousands of predominantly black Africans but she’s cool because she helped Cap in battle? Wanda wasn’t under mind control when she set Hulk loose in that city. She did it because she was a fiendish criminal.
