He is probably screwed. Yeah she was 17 and he was 20, but we have laws for a reason. You can't fuck 17 year olds. You just can't. Society has drawn the line at 18 and you have to stay behind that line. I don't know what he can do at this point, to be honest. If he did it, he did it. If not, I guess he can try to fight the accusation.

For the record, the age of consent in New York, along with many other states, is 17.

There are states where the legal age of consent is 16, so it is nowhere near as cut and dry as people think. It even points this out in the article.

I think about 10 states have 18 as their age of consent (including California), while the rest are at either 16 or 17. Anyway, I certainly don’t think it’s ridiculous for the age of consent to be 18, but I can’t say I agree with the perception that anyone over the age of 18 who dates a 17 year old is a “pedophile.”

onethreetwoI hope not as 17 and 20 is close enough in age for it not to be THAT big of a deal (assuming it was consensual) as at 17 your much closer to a adult than a child for sure. definitely not worth ruining someone over it. if it was 20 vs 14 I could see there being much more of a problem. because while 6 years ain't much of a difference in general, like say 18 vs 24, at 20 vs 14 it's a clearly problem. but even 20 vs 16 I would not flip out even though 20 vs 15 is really pushing it (I sort of see age 15 on the edge before major penalties will start to set in) and I could easily see how some people would frown on it since I feel 15 is on the edge. but just on a personal level, while the age of 15 is young I tend to consider that slightly closer to a adult than child (but at 14 I see that closer to a child than a adult). but 15 is pretty much my BARE MINIMUM cut off point as younger than this definitely looks bad unless of course they are close in age like say 16 vs 14 etc. even from a legal standpoint... ain't 16-17 sort of a grey area to where it won't be a clear cut case (especially given 20 years old is not that far apart)? ; even if he gets some penalty I can't see it being to a point it destroys his life over it assuming it was consensual. with all of that said I guess I could label things like about this in terms of a basic stop light colors Green(Go)/Yellow(Caution)/Red(Stop)... 14 and younger = Red 15 = Yellow with a bit of Red. (this seems to be the edge even if someone is being generous) 16-17 (maybe 15 if your being a bit generous) = Yellow (although I get some might consider 15 to be yellow/red-ish) 18+ = Green (this seems to be the only way one can be 100% sure they are in the clear) but... there are exceptions for those close in age. but if we where to take a typical 25-30 year old or so and have sex with someone younger, I feel the Red/Yellow/Green stuff above is about right, although like I mentioned, 15 might be more Red than Yellow with some people as while I don't know the details on the law, from what I can make out, 16-17 seems to be a grey area (sort of Yellow) but under this one might have a big problem and I would assume under 15 it will DEFINITELY be a problem to where your DEFINITELY screwed especially if your not close in age. like say 20 vs 14, the 20 year old is pretty much screwed, it's just a question of how much. but if it was 20 vs much under 14 then your pushing hardcore penalties since it's pushing pedo territory at that point. bottom line... I tend to agree with the general 18+ standard though as it's the only way someone can be 100% in the clear as any lower one risks potential legal issues it would seem. Personally I suspect many of these claims are just trying to get $$$, more than a legitimate claim. because if she did not make it crystal clear to him she did not want to have sex (like said no and shoved him away(this way they can be no doubts)), then anything in relation to sexual assault/rape etc is pretty much BS. plus, I think a lot of people exaggerate what happened. like they will take a fairly minor offense and blow it up like he flat out raped her etc. granted, I don't know that situation so I can't really say too much either way, but I think what I am saying here is definitely a factor when you look at these types of claims nationwide/worldwide. because to make a serious accusation like that, it can destroy the person, so you damn sure better not be exaggerating etc.
