It’s time to return to normal. If you aren’t vaxxed by now then I don’t think society should cater to you. And if you are vaxxed then theaters are perfectly safe.

Don't forget that the Disney Plus Premiere Access feature is a very new innovation that didn't exist even one year ago. Her contract for this film pre-dates its existence. And had it not been for the pandemic, Disney may not have been as hasty at rolling it out. In all likelihood, her people were negotiating from a conventional late 2010s perspective and may have had no idea such a mechanism was going to arise as a possible method of distributing the film.

I'll bet that there is more than we are told too. But as for how the lawyer missed it... it could have been misrepresented. It might have been good faith deal that didn't have every I dotted or T crossed. It might have been where Disney said "Meh, we'll do whatever we want. NO ONE CAN STOP US ANYWAY!!!!!" And don't forget, this deal and movie were made BEFORE Covid, which changed everything. Doing a "pay to see" on their streaming service was most likely not on the table then.
