It just further demonstrates the Avengers' arrogance and contempt for the people. If Black Widow thinks that what she did was right, then stay and defend herself in front of a jury. But Black Widow, just like Cap, don't want to have to answer to the people for their actions.
we have a criminal justice system where all accused have a constitutional right to a trial by jury. But Cap and Black Widow are clearly against the justice system and against jury trials because they don't want to answer to the people and they want to be judge and jury instead.
