I know this is a film, but for logic's sake, taking into account how the justice system works, he killed his sister at a young age. Obviously, the state can't put a six-year-old kid in a prison, so understandably he was put in a psychiatric hospital. But he broke out with the intent to kill again, got recaptured. He's over 21, but he was put back into the psychiatric hospital. Even in a court, it'd be a stretch for a defense lawyer to argue that he was insane and didn't know what he was doing. So shouldn't Michael be locked up in a maximum security prison?

I would say it would be more about not being able to help himself and with his childhood past and doctor's reports, yes, he would be placed in a high risk psychiatric institution. If he was in a MSP, what do you think he would do to the other inmates? That said, Myers wasn't recaptured and placed back into custodial care. He was shot in the eyes and blown to smithereens along with Loomis at the end of Halloween 2 - 81'. I do not hold much faith for this reboot and quite frankly, there are other horror films coming that appear far superior, like the Suspria and Pet Sematary remakes. Even the trailer didn't make Myers that scary and they even telegraphed a shock in it to make him appear scary at the end of the trailer when the closet door wouldn't close properly on the babysitter. Yeah, real scary when you know what is going to happen. Even Curtis looks ridiculous. Put him in solitary.

He was mentally psychotic though. He needed qualified psychiatrists around him, not dunderheaded dense prison guards. But is he though? Technically you could say that for any killer, even known serial killers like Bundy or Gacy but they all were imprisoned, some were even executed.

Well, in Loomis’ monologue, he said he spent “8 years trying to reach him and then another 7 trying to keep him locked up”, so that would mean if he escaped 8 years after 6 yrs old, that would make him 14. So he should at least be held hostage in his teen years.
Okay, maybe this doesn’t make a whole lot of sense, but maybe Loomis thought that he was too smart and evil to be kept in a silly prison, liable to escape. So he kept him in the sanitarium to cure his insanity, I guess.

I don't actually agree with you that it would be difficult for the defence to argue insanity on his behalf, OP. Loomis is clearly of the opinion that Myers is completely psychotic. The psychiatric hospital is the proper place for him.

Good point but I think the bigger question is were they really able to keep Michael locked up all those years 'cause they wanted to or only 'cause Michael wanted to stay there and didn't feel like it was the right time to go back into the world then 'cause Michael has been long portrayed as this unstoppable force of evil and he may have been able to escape a lot earlier if he wanted to but was waiting for the right time to escape.
