I could understand it if the burgulars she had driven had killed someone. I may not agree but at least I'd understand it. But this just seems like piling on.

That does seem pretty retarded. I wonder whether the three other burglars will also be charged posthumously for their own murders? In the UK we have a similar law, known as 'Joint Enterprise' where everybody associated with a crime are deemed jointly responsible for a violent act committed during the course of that crime. But I think the prosecution has to establish that the defendants could have foreseen that violent act, which they'd be unlikely to succeed in doing in this case. Actually the (UK) Supreme Court recently ruled that the 'Joint Enterprise' law has been misinterpreted for the past 30 years. So maybe the US will follow suit!

tickingmaskIt's a state law so not everyone in the States does it. This is actually the first I've heard of this. The dude who actually shot the burglars is still being investigated to make sure he wasn't a gun nutter, but he will probably be cleared of wrongdoing. My big problem is that there is no way for any real due process to happen. The evidence will solely be based on a guy shooting her friends which will obviously be easy to prove. He could even brag about it. So on the face of it she would appear to be doomed. I don't even see how it could be a part of a plea deal. It's bonkers.

There's normally a real link, even with hate crimes, but this one has no upside to it.
Why would they offer a plea deal to drop murder charges where they don't even have to prove a murder just to nab her on an accomplice charge?
The murder charge is a bigger slam dunk than the accomplice charge which is pretty air tight too.
I think it's a pile on law, but I think it's one that's meant to stick.
