Ok, so first off, I know they weren't actually talking about the X-Men, buuuuuuut,
Vision specifically stated after they were presented with the Accords that the number of known powered persons had grown at an exponential rate, and of course, we know later that Tony has been tracking at least 1 in Spiderman and probably others.
I say these could easily include mutants, who either through growing numbers, or some sort of incident or other reason are getting forced more and more into the public eye. It's possible even that the public has been aware of them, but simply wasn't aware of how big the problem was an so it hasn't existed as a type of perceived global threat.
I also like the concept that the difference between them and the Avengers is that the Avengers aren't hiding and don't have secret identities and thus are accepted generally, while the X-Men would be hiding and have an unknown number of members literally everywhere, and that makes them a source of fear to the public.

Actually, you can take what Killian said in IM3 about Humanity "Destined to be upgraded" as a hint of the X-Men.
