There seems to be yet another roadblock apparently FOX does not have the rights. Will Marvel work something out to bring them hone? Will they end up like Hulk and appear in other films but no solo films? Will they fade away and be forgotten.

They could send in some rebel spies to infiltrate CF and get the FF back. Or just Steve. He's snuck into and rescued captives from Hydra and the Raft now...

Fox is licensing the rights to produce Fantastic Four movies from a German financier. If Disney buys Fox, they inherit those licenses. Disney can still make Fantastic Four movies as long as they follow the same stipulations as Fox. It's admittedly a roundabout way to get movies based on your IP made but, it can be done. All this really means is that Disney is likely to start with FF movies as opposed to X-Men movies due to the alleged time stimulation in the Fox license.

Remember that it took decades to work out the Hobbit deal.

Constantin has produced all four Fantastic Four films, while Fox has distributed all three that have had cinematic releases. Doesn't that tell you something? It tells CBR that “Constantin retains the production rights first sold to them in 1986, but that Fox has exclusive distribution rights as part of the 1999 deal with Marvel.” It does but, that still doesn't make for a show stopping obstacle. If Fox has exclusive distribution rights and Disney buys Fox, what materially changes? Do you think they'd really go shopping for another distributor? It's obvious that Constantin can't produce an FF film on their own.
