Wanda doesn’t have a visa and couldn’t get one if she tried. Tony Stark trafficked this uneducated criminal Sokovian and keeps her prisoner in his mansion. Technically it was Ultron that smuggled her into the US IIRC. After that she was probably given refugee status or more probably a working visa if she was working for the Avengers. Then again, Thor worked for the Avengers and I doubt he cared about any such thing as a visa. I don't think Ultron ever had the twins on US soil. They went from Sokovia to Africa to Korea and back to Sokovia. |

Aliens are not human and therefore come under quarantine laws. Since aliens have never been documented as arriving on Earth, we do not actually know what kind of laws they'll come under. And Wanda is an enhanced individual that have acted to save the world. Since no occurrence of these kind of individuals exist in real life, we do not know what kind of real life documentation they would or wouldn't need. |

That would make him a good guy then, right? Cap has no regard for authority when he thinks it's something he can break the rules for, people like Cap, Wanda sided with Cap, therefor Stark's actions were good.

Could be confirmation of her lack of visa or could be a statement regarding her ongoing one should they refuse to sign the accords, the Avengers were officially or not endorsed by the government until the casualty list got too big, refusing to sign the accords would put them on the wrong side of the government who then could refuse any kindness or leniency they had shown to Wanda for her past actions.
Starks statement could simply have been a warning to Cap that should they refuse to go along with things any amnesty they had enjoyed would quickly dissipate, as it was the government knew Wanda was in the US and with the Avengers but didn't try and eject her from the country indicating atleast a fragile understanding between the government and the team.
