Because he was never a member of The Avengers Tony Stark had called a press conference to announce Spider-Man as the newest Avenger. So Peter would've had to register (and Aunt May would've had to sign the Sokovia Accords for Peter since Peter is still a minor and can't sign a legal document) before that could've happen. Like I said, PLOTHOLE. MCU wanted to make SMH a high-school movie, but they forgot about the fact that Peter as a minor can't sign a legal document.

He doesn't want to out the kid. He was giving him the choice to do so at the end, but he wasn't going to out him, because he knows it's not the right thing to do.

He was a minor & she his guardian. Unless the press conference might've been a catalyst for that also - May knew Parker was 'working' with Stark & the world knows IronMan's business... maybe The Avengers would've first acknowledged Parker as a type of academy junior in training.

That's why Stark and Peter have been lying to Aunt May telling her that Peter is an intern for Stark and that's why he took Peter to Germany (which is effectively kidnapping of a minor since he transported Peter out of the country under false pretenses, lying to Aunt May). And Aunt May never knew Peter is Spider-Man until the final scene of SMH so Stark obviously never consulted Aunt May.

That was kinda the whole point/lesson he wanted Peter to go learn that being an Avenger isn't everything. You can tell because Tony was hardly surprised that Peter didn't go thru with it and just shrugged it off.
